| Duke: We're not abandoning Cincinnati Indianapolis-based Duke Realty Corp. is pulling out of Cleveland, but says it is committed to the Cincinnati area despite plans to sell about 2.3 million square feet of existing office space and drop an office tower project there. A Duke spokesman said the company instead is juggling its portfolio to gain the best land positions. In recent months, Duke has unloaded virtually all of its properties in Cleveland, saying opportunities were greater elsewhere.
Conseco slapped with rating downgrades Standard & Poor's and A.M. Best have downgraded debt of Conseco Inc. after second-quarter earnings released by the Carmel-based insurer Monday evening disappointed investors. Standard & Poor's bumped senior debt ratings and counterparty credit ratings to B+ from BB-. A.M. Best cut its rating to B+ from B++.

| | Indianapolis income growth fell behind last year Per-capita personal income rose 4 percent in the Indianapolis area in 2006, less than the 5.4-percent average increase across all metro areas, the U.S. Department of Labor reported yesterday. The Indianapolis area saw per-capita income climb to $37,849 from $36,391. The region's income level ranked 59th. The average of all metro areas increased to $38,109 from $36,140. The figures are the most recent available.
Hoosier Park indoor space could double Officials of Hoosier Park plan to build a 92,696-square-foot facility at the Anderson horse track for the addition of slot machines. Officials of track owner Centaur Racing rolled out the plans to the Anderson Park Board last night, according to The Herald Bulletin. The horse track leases property from the city, and the plans must be OK'd by several local and state government offices.
FedEx lawsuit could cost $630 million A federal judge in South Bend this month will weigh whether lawsuits filed by independent contractors against FedEx Corp. in two dozen states should be combined. About 150 independent contract drivers, designated by FedEx as part-time employees, seek to be classified as full-time workers, according to Bloomberg. That would entitle them to benefits and paid time off.

Prison escapee captured in Montana Montana police have captured Kelvin Fuller, who escaped from the Westville Correctional Facility a week ago. Police noticed Fuller's car after he dropped off a hitchhiker. Since escaping, he's been accused of stealing a car and robbing a gas station and a bank. Fox 59 first reported the capture and will have more at 10 p.m.
Hot weather prompts heat advisory The hot weather has prompted Mayor Bart Peterson to activate the city's extreme heat plan. He and other city officials, as well as the Marion County Health Department and the Red Cross, are warning people to drink plenty of fluids and try to stay inside. Several cooling stations and spray grounds have been set up around the area.

| Arson crews investigate suspicious south-side fire Firefighters this morning battled a suspicious south-side garage fire that knocked out power to at least three neighboring homes. Firefighters responded to a garage fire at the same location, 2035 Boyd Ave., in June.
Questions about arresting power of police A judge's decision is raising questions about the arresting power of Indianapolis Metropolitan Police officers. Yesterday, a Marion County judge threw out a drunk-driving case because the arresting officer was not properly sworn into duty following the merger of the Indianapolis Police Department and Marion County Sheriff's Office. The prosecutor's office argues that the ordinances passed by the City-County Council transferred the arresting powers to the new police force.
Delivery man impersonator attacks Fishers woman Police say a Fishers woman was assaulted by a man she thought was an overnight delivery person. Investigators believe Lawrence Carl, Cicero, was dressed as a DHL worker when he forced his way into the woman's home. Police say Carl ran when the victim fought back, but left identifying personal items at the scene.

| City's exit from Sherman Park concerns neighbors, new owner When the city of Indianapolis relocates two of its departments later this year from Sherman Park on the near-east side to 1200 S. Madison Ave., some say the city is merely trading one blighted area for another-and abandoning a neighborhood it has said it wants to help. And over the 10-year lease with Pillar Investments LLC , owner of the Madison Avenue property, the city will pay nearly $1.2 million more in rent than it would have, had it stayed at Sherman Park.
